This course will educate the learner on fair lending procedures and regulations. This course will also discuss marketing and advertising, and the interview process for loans. After completing this program, the learner will be able to:

  • Adhere to federal regulations surrounding fair lending.
  • Understand requirements for taking credit applications and evaluations.

Course Topics

T1. Fair Lending: This topic will define fair lending and will provide the learner with procedures for understanding and complying with fair lending and how to identify and prevent the different types of discrimination.

T2. Fair Housing Act: This topic will familiarize the learner with the Fair Housing Act (FHA) and its basic requirements regarding fair treatment of inquiries, underwriting standards, and equal housing opportunity

T3. Marketing and Advertising: This topic will focus on fair marketing and advertising procedures by defining the marketing function and familiarizing the learner with prohibited activities.

T4. Homeowners Protection Act (HPA): This topic will familiarize the learner with several aspect of the Homeowner's Protection Act, including, but not limited to, private mortgage insurance, borrower requested cancellation, and automatic termination.

T5. HPA Disclosure and Notice Requirements: This topic will familiarize the learner with disclosure and notice requirements for multiple types of mortgage transactions, in addition to notifications of termination dates.

T6. ECOA: This topic will define the Equal Credit Opportunity Act (ECOA) and will provide the learner with requirements for taking credit applications and evaluations, extending credit, and information monitoring.

T7. Appraisals: This topic will familiarize the learner with appraisals, including applicant notifications, written requests, and copies of the appraisal.

T8. Interview Process: This topic will familiarize the learner with the interview process by defining pre-approvals and differentiating between prohibited and acceptable information requests.

T9. Underwriting: This topic will familiarize the learner with underwriting by providing lists and explanations of essential considerations, prohibited activities, and any difficulties that an underwriter may face.

T10. Notification of Action Taken: This topic will familiarize the learner with the requirements for notifying applicants when actions have been taken regarding their loan applications, included are instructions for small and large business loans.

T11. Fair Debt Collection Practices Act: This topic will define the Fair Debt Collection Practices Act and will familiarize the learner with its various aspects, including communication with third parties and consumers, consumer notifications, and unfair practices.

T12. Third-Party Relationship Management: This topic will discuss the necessity of third-party oversight, particularly in accordance with Consumer Financial Protection Bureau (CFPB) regulatory requirements, and will explore key points of a financial institution's vendor management program.
